Grace also has not alleged that Kane had knowledge of any defense at the time he took the check In conclusion, Kane has met the requirements he was a holder in due course. There are ambiguities present because the trial court held that Kane was not a holder in due course because he did not prove he took the check in good faith and without notice of Grace’s defenses. The burden of proof in this case lies with Grace and none of the affidavits supplied by either party suggest evidence of bad faith. Ethical guidelines are defined as a simple tool to help determine whether an action is moral. The law creates a legal binding. The fact a culture might be wrong about what is morally correct, and instantiates laws to reflect their views, does not mean their laws are not based on morality, but that the moral views on which they are based are simply wrong.
